Legal Disclaimer & Waiver of Liability

1. Age & Consent

You affirm that you are 18 years of age or older, or that you have obtained written permission from a parent or legal guardian who will be present during the session. You are voluntarily engaging in a personal, intuitive service that is not medically, legally, or professionally necessary.

2. Nature of Services

All sessions are intended solely for entertainment and personal reflection, and are based on the practitioner’s intuitive impressions, not on any scientifically verified or professional method.
Sessions have no diagnostic, therapeutic, or legally binding value and are not to be relied upon for decisions involving health, safety, or personal risk.
You understand that the services provided do not involve any licensed healthcare, therapy, or legal counsel.

3. No Guarantees

No outcome, insight, or interpretation is guaranteed.

You acknowledge that results may vary and are subject to your personal interpretation.
Sessions are not intended to be factual or verifiable, and do not provide medical, legal, financial, or psychological advice.

4. Confidentiality

Sessions are confidential and will not be recorded, distributed, or publicly disclosed without your written permission.
However, The Gift LLC reserves the right to disclose information if legally required (e.g., in cases of imminent harm, abuse, or court subpoena).

5. Assumption of Risk

By participating in a session, you accept that all insights are subjective and exploratory, and that any choices or actions you take following the session are your sole responsibility.
You understand and accept that these sessions may evoke emotional responses, personal discomfort, or reflection on past trauma. You agree that any emotional reaction is your own responsibility and not grounds for legal complaint or refund.

You agree that no claim for emotional distress, dissatisfaction, or discomfort shall exceed the original fee paid for the session.

6. Limitation of Liability

To the fullest extent permitted by law:

• You waive and release Payton Thurston, The Gift LLC, and its affiliates from any and all claims, liabilities, or damages, known or unknown, arising out of or relating to your participation in any session.

• You agree that any claims, including those related to emotional distress, dissatisfaction, or personal interpretation, shall be limited to the amount paid for the session.

• You acknowledge that this waiver does not cover claims of gross negligence, fraud, or willful misconduct where such waivers are prohibited by law.

7. Indemnification

You agree to indemnify and hold harmless Payton Thurston and The Gift LLC from any claims, disputes, or legal actions brought by third parties related to your participation, unless caused by willful misconduct or fraud by the provider.

8. Governing Law & Jurisdiction

This agreement shall be governed by the laws of the State of Vermont, without regard to its conflict of law principles.
You agree that any dispute or claim shall be resolved exclusively in the state or federal courts located in Addison County, Vermont.

You agree to waive any objection to personal jurisdiction or venue in Vermont courts, even if you reside outside the state.

By signing below (in person or electronically via booking form), you confirm that:

• You voluntarily agree to all terms before receiving any services.
   

You accept that checking an “I agree” box, submitting payment, or attending a session constitutes legal acceptance of this agreement.
